These Terms of Service (“Terms”) are a legally binding agreement between you and SilkennSkills LLC (“SilkennSkills,” “Enlistra,” “we,” “us,” or “our”). They govern your access to and use of enlistra.com, Enlistra applications, research tools, features, content, and related services (collectively, the “Service”). By creating an account, clicking to accept these Terms, purchasing a plan, connecting a third-party account, or otherwise using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
These Terms are between you and SilkennSkills LLC only. They do not create a contract between you and Etsy, Inc. or any other third party. Mandatory legal rights that cannot be waived remain unaffected.
1. About Enlistra
Enlistra provides research and productivity tools for online sellers. Depending on the features enabled, the Service may include keyword research, product and market research, listing and shop research, title or tag suggestions, trend indicators, saved projects, exports, educational resources, and related functionality. Features, sources, availability, and plan limits may change over time.
Enlistra is an independent service. Unless expressly stated otherwise and authorized, Enlistra is not affiliated with, endorsed by, sponsored by, or certified by Etsy, Inc. Etsy and related marks belong to their respective owners.
2. Eligibility and accounts
You must be legally capable of entering into a binding agreement under the laws that apply to you. If you use the Service for a company or another person, you represent that you are authorized to bind that entity or person.
Provide accurate, current registration information and keep it updated. Use your own account; do not impersonate another person, create accounts through automated means, sell or transfer an account, or share credentials in a way that compromises security. You are responsible for activity conducted through your account except to the extent caused by our breach of a non-waivable legal duty. Notify support@enlistra.com promptly if you suspect unauthorized access.
3. Acceptance and electronic communications
You must accept these Terms and the Privacy Policy through the acceptance flow presented during registration or before the relevant use of the Service. We may record the version accepted, timestamp, and related account or transaction information to document acceptance. Notices, invoices, policy updates, and other communications may be provided electronically, subject to applicable law.
Before launch, Enlistra should implement a clear, affirmative click-through or equivalent acceptance experience. A footer link alone may not establish acceptance.
4. Service features, research outputs, and limitations
Enlistra may present estimates, scores, suggestions, comparisons, trends, metrics, and other research outputs. Results may depend on available data, third-party providers, user inputs, sampling, models, algorithms, timing, location, and platform changes. Unless expressly identified and substantiated as a verified fact, treat a result as an estimate or directional indicator rather than an exact count or guarantee.
We do not guarantee that data will be complete, current, uninterrupted, error-free, available for every query, or consistent with results shown by another tool. You are responsible for reviewing results and making your own business decisions. Enlistra does not guarantee sales, revenue, profit, ranking, traffic, conversions, or any particular commercial outcome.
5. Etsy API and Third-Party Platform Compliance
Some Enlistra features may interact with Etsy or other third-party services when the relevant integration is implemented and authorized. Use of these integrations is subject to the applicable third-party terms, permissions, policies, and authorization requirements. Users must maintain any required authorization and may revoke access through Enlistra’s available controls or the relevant provider.
Etsy API Access and Application Approval
Where Enlistra accesses Etsy through the Etsy API, its integration and use of Etsy data will be governed by Etsy’s then-current API Terms of Use, Developer Policies, applicable privacy requirements, and other relevant Etsy policies.
Etsy provides different API access paths, including Seller App access, Personal App access, and Commercial Access. The appropriate path depends on the application’s purpose, intended users, scale, and use case. Commercial Access requires an approved Personal App and a separate request to Etsy. Enlistra will use the applicable access level and obtain any approvals required for its actual use case before relying on that access.
Etsy may review applications and API usage and may impose applicable limits or require changes in accordance with its policies. Enlistra will respond to applicable compliance requirements and make changes where required.
Permitted Use of Etsy Data
Enlistra may use Etsy API data to provide its implemented features, such as connected-shop information, listing information, and available shop-performance analytics, to the extent permitted by Etsy’s API Terms, the approved application purpose where applicable, and the permissions granted by the user.
Any analytics, aggregation, reporting, or other processing of Etsy API data will be carried out subject to the applicable API Terms and policies. Enlistra will not assume that API access or Commercial Access automatically authorizes every possible data use. Where Etsy’s terms or policies require specific approval or impose restrictions on a proposed use, Enlistra will obtain the required approval or adjust, limit, or disable the relevant functionality.
Data Access, Caching, and Security
Enlistra will request and process data and permissions appropriate to its implemented features and authorized use case. Etsy API data will be accessed, displayed, cached, retained, and deleted in accordance with the applicable Etsy API Terms, permissions, security requirements, and relevant privacy commitments.
Enlistra will not use screen-scraping or other methods that circumvent Etsy’s API access controls to retrieve or submit Etsy data.
Where required by Etsy’s Commercial Access review criteria, Enlistra will clearly distinguish its service from Etsy and display the required trademark disclaimer:
“The term ‘Etsy’ is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.”
If Enlistra’s integration or intended use changes in a way that requires additional approval, permissions, or review, Enlistra will address those requirements before using the API for that purpose.
Third-party platform policies may change over time. Enlistra’s use of Etsy and other third-party services remains subject to the applicable terms and requirements in effect at the time of use.
6. Etsy seller and member data
Where a seller authorizes Enlistra to access data through an approved integration, Enlistra will process it only to provide the requested feature and as described in the Privacy Policy, the seller’s agreement with Enlistra, the granted permissions, applicable law, and governing platform terms.
If Etsy Member personal information is made available, Enlistra will handle it only to the extent authorized and necessary to provide the contracted service, with appropriate safeguards. We will not sell, transfer, or commercialize API credentials or Etsy Member data, and will not use such data for unsolicited marketing or connect it to third-party advertising or marketing platforms where prohibited.
Users must not provide credentials or personal information they are not authorized to share. The Privacy Policy must accurately describe data categories, purposes, storage, security, disclosures, retention, deletion, and available controls.
7. Acceptable use
Use the Service only for lawful purposes and within your plan limits and granted permissions. You must not, or help anyone else to:
Violate applicable law, intellectual-property rights, privacy rights, contracts, or third-party policies.
Use bots, scripts, crawlers, browser extensions, automated systems, or systematic scraping to access Enlistra, Etsy, or Etsy data except where expressly authorized in writing and permitted by applicable terms.
Bypass authentication, rate limits, quotas, security measures, or technical restrictions; make excessive requests; or interfere with service availability.
Use Etsy API data for analytics, AI or machine-learning training, licensing, content removal, or another restricted purpose without Etsy’s express written authorization.
Copy, reproduce, download, or exploit another seller’s photos, designs, listings, or other protected content without necessary rights.
Use or facilitate listings or transactions that violate Etsy’s Creativity Standards, Prohibited Items Policy, intellectual-property rules, anti-discrimination rules, or other applicable platform policies.
Mimic Etsy’s core functionality, bypass Etsy checkout, divert Etsy transactions, misrepresent affiliation with Etsy, or use Etsy marks misleadingly.
Manipulate shop statistics, reviews, ratings, views, or engagement; generate fake or misleading reviews; or use the Service to send spam or unsolicited marketing.
Upload malware, attempt unauthorized access, reverse engineer the Service except where prohibited by law, or develop a competing product through prohibited extraction.
Share credentials, resell access, transfer API credentials or third-party data, or allow unauthorized users to access the Service.
Upload or transmit unlawful, threatening, harassing, defamatory, deceptive, malicious, or infringing content.
We may investigate suspected violations and take proportionate action, including usage limits, corrective steps, suspension, termination, or referral to a relevant provider or authority where warranted. Where reasonably practicable and lawful, we will provide notice and a way to raise a concern.
8. Plans, fees, taxes, and payment
Some features require payment. Checkout will state the applicable price, billing interval, plan features, usage allowances, renewal terms, and any taxes or fees shown. SilkennSkills LLC—not Etsy—is responsible for providing Enlistra, setting and collecting Enlistra fees, issuing invoices or receipts as applicable, and handling billing support.
By purchasing a subscription, you authorize the payment processor to charge the selected payment method for disclosed charges and renewals. Subscriptions renew only as described at checkout until cancelled. Maintain valid payment details and pay applicable charges and taxes. If payment fails, we may notify you and restrict paid access until resolved, subject to law.
We may change prices or plan features prospectively and provide advance notice where required. A change will not retroactively alter a completed purchase. Usage limits, credits, exports, and feature availability may vary by plan and be subject to reasonable fair-use or technical limits.
9. Cancellation and refunds
You may cancel a subscription using the account or billing controls made available by Enlistra, or by contacting support@enlistra.com if those controls are unavailable. Unless checkout terms or applicable law state otherwise, cancellation stops future renewals and paid access continues until the end of the current paid period.
Refund requests submitted within seven (7) calendar days of the relevant purchase may be reviewed under the Refund & Cancellation Policy. A request within that period is not an automatic approval or guarantee of a refund. Mandatory statutory rights and specific promises made at checkout remain unaffected. The Refund & Cancellation Policy is incorporated by reference.
10. User content and feedback
You retain rights you own in content you submit, upload, save, or transmit through the Service (“User Content”). You grant SilkennSkills LLC a limited, non-exclusive permission to host, process, reproduce, and display User Content only as reasonably necessary to provide, secure, maintain, and support the Service, subject to the Privacy Policy and law. You represent that you have the rights and permissions needed to provide User Content.
Do not upload passwords, payment-card details, sensitive personal information, or confidential third-party information unless the Service specifically requests it and you are authorized to provide it. Suggestions or feedback may be used to improve the Service without compensation, without transferring ownership of your pre-existing intellectual property.
11. Enlistra intellectual property
The Service’s software, interface, design, branding, documentation, and original content are owned by or licensed to SilkennSkills LLC and protected by law. Subject to these Terms and plan limits, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your lawful research and business purposes. No other rights are granted by implication.
You may not copy, sell, sublicense, publicly distribute, reverse engineer, or create derivative works from the Service except as permitted by law or expressly authorized in writing. Third-party names, logos, and data remain the property of their owners.
12. Third-party services and links
The Service may depend on or link to third-party platforms, data providers, payment processors, hosting providers, and other services. Those services are controlled by their providers and may be subject to separate terms and privacy policies. Enlistra is not responsible for third-party services to the extent permitted by law. Third-party availability, data, policies, and features may change without notice.
13. Support and service availability
For support, contact support@enlistra.com. We will use reasonable efforts to respond to seller inquiries in a timely manner. Response times are not guaranteed unless a specific service level is expressly agreed in writing.
We aim to keep the Service available but do not promise uninterrupted or error-free operation. Maintenance, security events, upstream platform changes, third-party outages, or circumstances outside our reasonable control may affect the Service. We may update, suspend, or discontinue features as reasonably necessary, subject to law and specific commitments.
14. Discontinuation of Etsy API features
If Enlistra discontinues an application that uses Etsy’s API, we will comply with applicable Etsy notice and transition requirements, including any required advance written notice to Etsy and affected Etsy sellers, unless Etsy authorizes a shorter period or requires immediate suspension. During a required notice period, we will maintain the relevant service and provide transition support to the extent required by Etsy’s applicable terms.
15. Suspension and termination
You may stop using Enlistra at any time and cancel subscriptions as described here. We may suspend or terminate access where reasonably necessary to address material breach, non-payment, suspected fraud, security risk, unlawful conduct, third-party policy violations, or legal requirements. Where reasonable and lawful, we will give notice and an opportunity to resolve the issue.
Upon termination, your permission to use the Service ends. We may delete account information and saved data according to the Privacy Policy and retention practices, subject to legal obligations and applicable third-party data requirements. Provisions that by nature should continue after termination will survive.
16. General warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR NEEDS. NOTHING HERE EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.
17. Etsy API warranty disclaimer
If Enlistra uses the Etsy API, include the following Etsy-required disclaimer in the Application Terms. Confirm the developer name and exact current wording against Etsy’s API Terms before publication:
DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY SILKENNSKILLS LLC (THE “APPLICATION DEVELOPER”). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.
This Etsy-specific disclaimer is separate from the general warranty disclaimer above. If Etsy changes its required wording, the current Etsy wording controls.
18. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILKENNSKILLS LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ENLISTRA FOR THE SERVICE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. These limits do not apply to liability that cannot lawfully be limited or non-waivable consumer rights.
19. Indemnification
To the extent permitted by law, you agree to be responsible for reasonable losses, liabilities, and costs arising from your unlawful use of the Service, material breach of these Terms, or infringement of a third party’s rights. This section does not apply to the extent a claim was caused by our own conduct or where indemnification is prohibited by law.
20. Intellectual-property complaints
If you believe content available through Enlistra infringes your copyright or other intellectual-property rights, contact support@enlistra.com with the subject “IP Notice.” Include your contact information, identification of the protected work, the material and its location, an explanation of your rights and good-faith belief, and information reasonably needed to assess the notice. We may request additional details and may remove or restrict material where appropriate or legally required.
21. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, including information associated with third-party integrations. It is incorporated into these Terms by reference. If Enlistra processes personal information through an Etsy integration, the Privacy Policy must accurately describe data categories, purposes, storage, security, disclosures, retention, deletion, and available controls.
22. Changes to the Service or Terms
We may modify the Service and update these Terms to reflect changes in the product, business, law, security practices, or third-party requirements. We will update the effective date and provide notice of material changes where required. Where new acceptance is legally required, we will request it. Continued use after an update constitutes acceptance only to the extent permitted by law.
23. Governing law and disputes
These Terms are governed by the laws of WYOMING, United States, excluding conflict-of-law rules, except where mandatory law provides otherwise. Courts located in WYOMING, United States will have jurisdiction, subject to non-waivable rights that may allow a claim elsewhere. Qualified counsel should review this clause for the actual state of formation, consumer-law obligations, and enforceability.
24. General provisions
If a provision is held unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision is not a waiver. You may not assign these Terms without written consent, except where law provides otherwise. We may assign these Terms in connection with a merger, reorganization, or transfer of the relevant business, subject to law. These Terms, the Privacy Policy, the Refund & Cancellation Policy, and any plan-specific terms accepted by you form the agreement concerning the Service, subject to mandatory legal rights.
